The Council of Ministers issued a number of decisions during its session held yesterday evening, Saturday, chaired by Prime Minister Ali Al-Zaidi. The Council directed the completion of procedures for issuing work permits for foreign labor. It also decided to authorize the Ministry of Electricity to sign an agreement for the development of the electricity sector with the American company GE, and approved the announcement of a public tender for printing school textbooks.
The Media Office of the Prime Minister stated in a statement followed by Al-Mirbad that “Al-Zaidi chaired yesterday, Saturday, the ninth regular session of the Council of Ministers, during which developments in the country were discussed, the items listed on the agenda were reviewed, and the necessary directives and decisions were taken regarding them.”
It added that “at the beginning of the session, the Prime Minister directed the Ministry of Interior and the National Investment Commission to coordinate and cooperate with the Ministry of Labor and Social Affairs to complete the procedures for issuing work permits in accordance with the law and the instructions in force when granting entry visas to foreign labor.”
It indicated that “the Council of Ministers approved the closure of the Labor Office affiliated with the Ministry of Labor and Social Affairs / Department of Labor and Vocational Training at the headquarters of the National Investment Commission, which was responsible for completing procedures for issuing work permits in accordance with the law and the issued instructions, as there is no longer a need for it due to the automation of procedures for granting entry visas electronically.”
It stated that “as part of the Government’s ongoing efforts to combat corruption, the Council of Ministers approved the recommendations resulting from the evaluation of the performance of ministries, entities not associated with a ministry, and governorates, as follows:
1. Complete the work of investigative committees within 60 days.
2. Increase the level of follow-up with the competent courts to resolve lawsuits filed long ago.
3. Follow up on the collection of amounts adjudged to be paid under court decisions to ministries or government entities.
4. All government entities shall address the observations recorded in the reports of the Federal Board of Supreme Audit, in a manner that ensures the development of their performance, and government institutions shall be obligated to develop guiding manuals and adopt specific programs and manuals to improve the level of performance in the field of combating corruption.
5. All government institutions shall be obligated to identify corruption phenomena, and shall be obligated to develop the efficiency of their employees and train them in the field of combating corruption.
It continued that “with the aim of enhancing the efficiency of investment planning, rationalizing public spending, and preventing the inflation of government project costs as a result of introducing new components, the following was decided:
1. It is prohibited to introduce or add any new component, activity, phase, action, or expansion to projects listed within the investment plan after their inclusion has been approved by the Ministry of Planning. Beneficiary entities shall be committed to implementing the project in accordance with the scope of work, components, costs, and objectives approved upon inclusion.
2. Any works that were not included in the project’s basic study, designs, or approved planning documents shall be deemed an independent project subject to the procedures of inclusion, evaluation, comparison, and allocation in accordance with the legislation and controls in force.
3. Excluded from the provisions of this decision are cases imposed by public safety requirements, urgent technical requirements, or legal obligations that could not have been anticipated when preparing the project.
4. The Ministry of Planning shall review requests for amendment or addition and ensure that they are not used to change the scope of the project, increase its cost, split it, bypass the priorities of the investment plan, or merge it in a manner that affects the soundness of planning.
5. The Ministry of Planning shall issue the necessary controls to implement this decision, and no text that contradicts its provisions shall be applied.
It explained that “for the purpose of raising the quality of preparing government projects and ensuring the protection of public funds, the Council decided to obligate contracting entities to include in contracts for the preparation of studies, designs, auditing, and supervision an explicit provision holding the consulting entities responsible for design and auditing fully legally and contractually liable for any increase in project costs. This aims to end the phenomenon of financial waste and avoid technical errors in preparing bills of quantities and statements, provided that the Ministry of Planning prepares a unified mechanism to measure the extent of deviation between the estimated costs and the contractual and final costs of government projects, determine their causes and the resulting liability, and submit an annual report to the Council of Ministers on the entities causing such deviations and the measures taken against them.”
With regard to the electricity file, the Council of Ministers approved, according to the statement, authorizing the Ministry of Electricity to sign the agreement for implementing the comprehensive plan to secure Iraq’s energy and develop the electricity sector, production and transmission, with the American company GE, provided that the agreement shall enter into force simultaneously with the entry into force of the framework agreement intended to be signed between Iraq and the United States of America, after both parties sign it, and shall expire upon the conclusion of the contracts.
The statement explained that “as part of efforts to develop the oil sector, approval was granted to sign an agreement between the Ministry of Oil, represented by Basra Oil Company and North Oil Company, and the American company Chevron, including the advance payment agreement, the crude oil security agreement, and the letter of guarantee agreement, in a manner that achieves an increase in production.”
It continued: “The Council also approved Basra Oil Company signing a Heads of Agreement (HOA) and a Non-Disclosure Agreement (NDA) with the consortium of companies consisting of the American company Capital TI, the Qatari company UCC, and the American company Chevron, with the possibility of adding one of the public companies to this consortium, in order to proceed with the following strategic routes and projects:
* The Strategic Export Pipeline Project, Basra – Haditha – Kirkuk – Ceyhan.
* The Export Pipeline Project, Basra – Haditha – Baniyas.
This is to enable the consortium to begin preparing integrated technical and financial studies and plans and to compare these vital routes, without imposing any final financial or contractual obligations on the Ministry of Oil.”
It indicated that “with the aim of enhancing the flexibility of oil exports, approval was granted to exempt the tender for consulting services for the Basra–Haditha Crude Oil Export Pipeline Project from the Instructions for Implementing Government Contracts No. 1 of 2025, and to enable Basra Oil Company to proceed with referral and contracting procedures with KBR to provide consulting services for the project.”
In the same context, the Council voted to approve the addition of 25 thousand barrels of crude oil to the Iraqi-Chinese agreement and to open an account for it to ensure the fulfillment and payment of the financial obligations of the Iraqi side, in order to preserve Iraq’s credit position and ensure the continuation of project financing by the Chinese side.
In the education sector, the Council of Ministers approved authorizing the Ministry of Education to announce a public tender for printing school textbooks with reputable local and foreign companies, in coordination with the Ministry of Finance to finance the required amounts. It also approved assigning Al-Nahrain State Company for Printing and Production of Educational Supplies and School Textbooks, and authorizing it to enter into contractual commitments with governmental and private printing presses for the remaining titles when financial allocations are available.
The Council also approved the Ministry of Planning’s lending of the tablet devices used in the General Population and Housing Census, totaling 1,760 devices, to the General Real Estate Registration Directorate for use in entering data related to the project for establishing a database of property owners.
من ضمن القرارات .. مجلس الوزراء يوجه باستكمال إجراءات اصدار إجازة العمل للعمالة الأجنبية
أصدر مجلس الوزراء عددًا من القرارات خلال جلسته التي عقدت، مساء امس السبت، برئاسة رئيس الوزراء علي الزيدي، حيث وجه باستكمال إجراءات اصدار إجازة العمل للعمالة الأجنبية، وفيما قرر المجلس تخويل وزارة الكهرباء صلاحية توقيع اتفاقية تطوير قطاع الكهرباء مع شركة (GE) الأميركية، وافق على الإعلان عن مناقصة عامة لطباعة الكتب المدرسية.
وذكر المكتب الإعلامي لرئيس الوزراء في بيان تابعه المربد أن ” الزيدي، ترأس امس السبت، الجلسة الاعتيادية التاسعة لمجلس الوزراء، جرى خلالها مناقشة تطورات الأوضاع في البلاد، واستعراض الموضوعات المدرجة على جدول الأعمال واتخاذ التوجيهات والقرارات اللازمة بشأنها.”
وأضاف، أنه “وفي مستهل الجلسة، وجه رئيس مجلس الوزراء وزارة الداخلية والهيأة الوطنية للاستثمار بالتنسيق والتعاون مع وزارة العمل والشؤون الاجتماعية، لاستكمال إجراءات اصدار إجازة العمل وفق القانون والتعليمات النافذة عند منح تأشيرة الدخول للعمالة الأجنبية.”
وأشار إلى أن “مجلس الوزراء أقر غلق مكتب العمل التابع إلى وزارة العمل والشؤون الاجتماعية/ دائرة العمل والتدريب المهني في مقر الهيئة الوطنية للاستثمار، الذي كان يتولى مسؤولية إكمال إجراءات إصدار إجازة العمل على وفق القانون والتعليمات الصادرة لانتفاء الحاجة اليه، وذلك لأتمتة إجراءات منح سمات الدخول (الفيزا) إلكترونياً”.
وبين أنه “ضمن جهود الحكومة المتواصلة لمكافحة الفساد، أقر مجلس الوزراء توصيات نتائج تقويم أداء الوزارات والجهات غير المرتبطة بوزارة والمحافظات بحسب الآتي:
1. إنجاز أعمال اللجان التحقيقية خلال (60) يوماً.
مستوى المتابعة مع المحاكم المختصة لحسم الدعاوى المقامة منذ فترات طويلة. .2
متابعة استحصال المبالغ المحكوم بدفعها بموجب قرارات المحاكم إلى الوزارات أو الجهات الحكومية. .3
4.معالجة الجهات الحكومية كافة الملحوظات المثبتة في تقارير ديوان الرقابة المالية، بما يضمن تطوير أدائها، وإلزام المؤسسات الحكومية وضع أدلة استرشادية واعتماد برامج وأدلة محددة لتطوير مستوى الاداء في مجال مكافحة الفساد.
5. إلزام المؤسسات الحكومية كافة بتحديد ظواهر الفساد، وإلزامها بتطوير كفاءة موظفيها وتدريبهم في مجال مكافحة الفساد.
وتابع انه “بهدف تعزيز كفاءة التخطيط الاستثماري، وترشيد الإنفاق العام، ومنع تضخم كلف المشروعات الحكومية نتيجة استحداث مكونات جديدة، تقرر الآتي:
1. يمنع استحداث أو إضافة أي مكون أو نشاط أو مرحلة أو فعالية أو توسعة جديدة للمشروعات المدرجة ضمن الخطة الاستثمارية، بعد المصادقة على إدراجها من وزارة التخطيط، وتلتزم الجهات المستفيدة بتنفيذ المشروع على وفق نطاق العمل والمكونات والكلف والأهداف المصادق عليها عند الإدراج.
2. تعد أي أعمال لم تكن مدرجة ضمن دراسة المشروع الأساسية أو تصاميمه أو وثائقه التخطيطية المعتمدة، مشروعاً مستقلاً يخضع لإجراءات الإدراج والتقييم والمفاضلة والتخصيص على وفق التشريعات والضوابط النافذة.
3. يُستثنى من أحكام هذا القرار ما تفرضه متطلبات السلامة العامة أو المتطلبات الفنية الطارئة أو الالتزامات القانونية التي يتعذر توقعها عند إعداد المشروع.
4. تدقق وزارة التخطيط طلبات التعديل أو الإضافة والتأكد من عدم استخدامها لتغيير نطاق المشروع أو زيادة كلفته والتجزئة أو تجاوز أولويات الخطة الاستثمارية أو دمجها بصورة تؤثر في سلامة التخطيط.
5. تصدر وزارة التخطيط الضوابط اللازمة لتنفيذ هذا القرار، وعدم العمل بأي نص يتعارض مع أحكامه.
واوضح انه “لغرض رفع جودة إعداد المشروعات الحكومية، وضمان حماية المال العام، قرر المجلس إلزام الجهات التعاقدية بتضمين عقود إعداد الدراسات والتصاميم والتدقيق والإشراف، نصاً صريحاً يحمل الجهات الاستشارية المصممة والمدققة المسؤولية القانونية والتعاقدية الكاملة عن أي زيادة في كلفة المشاريع، وذلك لإنهاء ظاهرة الهدر المالي وتجنب الأخطاء الفنية في إعداد جداول الكميات والكشوفات، على أن تعد وزارة التخطيط آلية موحدة لقياس مقدار الانحراف بين الكلف التخمينية والكلف التعاقدية والنهائية للمشروعات الحكومية، وتحديد أسبابها والمسؤولية المترتبة عنها، ورفع تقرير سنوي إلى مجلس الوزراء بالجهات المتسببة بالانحرافات والإجراءات المأخوذة بشأنها .
وفي ملف الكهرباء، أقر مجلس الوزراء، بحسب البيان، تخويل وزارة الكهرباء صلاحية توقيع اتفاقية تنفيذ الخطة الشاملة لتأمين طاقة العراق وتطوير قطاع الكهرباء (إنتاج، ونقل) مع شركة (GE) الأميركية، على أن تدخل الاتفاقية حيز النفاذ بالتزامن مع دخول الاتفاقية الإطارية المزمع توقيعها بين العراق والولايات المتحدة الأميركية، بعد توقيع الطرفين عليها، وتنتهي عند إبرام العقود.
وأوضح البيان، أنه “ضمن جهود تطوير القطاع النفطي، جرت الموافقة على توقيع اتفاقية بين وزارة النفط (شركة نفط البصرة، وشركة نفط الشمال) مع شركة (شيفرون) الأميركية، والمتضمنة اتفاقية الدفعة المقدمة واتفاقية تأمين النفط الخام واتفاقية رسالة الضمان، بما يحقق الزيادة في الإنتاج”.
وتابع: “كما وافق المجلس على قيام شركة نفط البصرة بتوقيع اتفاقية مبادئ (HOA) واتفاقية سرية وعدم إفشاء معلومات (NDA) مع ائتلاف الشركات المكون من (شركة Capital TI الأميركية، وشركة UCC القطرية، وشركة شيفرون الأميركية)، مع إمكانية إضافة إحدى الشركات العامة لهذا الائتلاف للمضي في المسارات والمشروعات الستراتيجية التالية:
– مشروع أنبوب التصدير الستراتيجي (بصرة – حديثة – كركوك – جيهان).
– مشروع أنبوب التصدير (بصرة – حديثة– بانياس).
لتمكين الائتلاف من المباشرة بإعداد الدراسات والمخططات الفنية والمالية المتكاملة والمفاضلة بين هذه المسارات الحيوية، دون ترتب أي التزامات مالية أو تعاقدية نهائية على وزارة النفط.
وأشار إلى أنه “بهدف تعزيز مرونة تصدير النفط، تمت الموافقة على استثناء المناقصة الخاصة بالخدمات الاستشارية لمشروع أنبوب تصدير النفط الخام بصرة- حديثة من تعليمات تنفيذ العقود العامة (1 لسنة 2025)، وتمكين شركة نفط البصرة للمضي بإجراءات الإحالة والتعاقد مع شركة (KBR) لتقديم الخدمات الاستشارية للمشروع”.
وفي السياق ذاته، صوت المجلس بالموافقة على إضافة (25) ألف برميل من النفط الخام إلى الاتفاقية العراقية الصينية، وفتح حساب لها لضمان سد وتسديد الالتزامات المالية للجانب العراقي، للمحافظة على موقف العراق الائتماني واستمرار تمويل المشروعات من الجانب الصيني.
وفي القطاع التربوي، وافق مجلس الوزراء على تخويل وزارة التربية صلاحية الإعلان عن مناقصة عامة لطباعة الكتب المدرسية مع الشركات المحلية والأجنبية الرصينة، وذلك بالتنسيق مع وزارة المالية لتمويل المبالغ اللازمة، تكليف شركة النهرين العامة لطباعة وإنتاج المستلزمات التربوية وطباعة الكتب المدرسية، وكذلك تخويلها صلاحية الدخول بالالتزام التعاقدي مع المطابع الحكومية والأهلية لما تبقى من العناوين عند توافر التخصيصات المالية.
ووافق المجلس على إعارة وزارة التخطيط للأجهزة اللوحية (التابلت) التي استخدمت في التعداد العام للسكان والمساكن، والبالغ عددها (1760) جهازاً إلى دائرة التسجيل العقاري العامة لاستخدامها في إدخال البيانات الخاصة بمشروع إنشاء قاعدة بيانات لمالكي العقارات.
